UNIT 323: SUPPORT USE OF MEDICATION IN SOCIAL CARE SETTINGS

      1.1 IDENTIFY LEGISLATION THAT GOVERN THE USE OF MEDICATION

  * The Human Medicines Regulations 2012;
  * Equality Act, 201;
  *   Misuse of Drugs Act 1971 & Regulations;
  * The Safer Management of Controlled Drugs Act 2006
  * Health & Safety at work Act 1974
  * Mental Capacity Act 2005
  * The Control of Substances, Hazardous to health Regulations (COSHH)
  * Hazardous Waste Regulations 2005
  * The Access to Health Records Act 1990
  * The Data Protection Act 1998

1.2 OUTLINE THE LEGAL CLASSIFICATION SYSTEM FOR MEDICATION

There are 3 categories of medicine in the UK namely:
  * Prescription only medication (POM) – available from a pharmacy if prescribed by an appropriate practitioner.
  * Pharmacy medicines (P) – available only from a pharmacist but without a prescription
  * General Sales List (GSL) – available at any shop without a prescription

1.3 Explain how and why policies and procedures or agreed ways of working must reflect and incorporate legislative requirements

Policies and procedures are put in place to ensure that legislation is followed. It ensures that best practice is followed to ensure the safety of all –staff as well as the persons who need care. It creates a safe working environment and protects both the medication giver and receiver.
